All and whole the farm of broombank in the parish of glenbervie and county of kincardine, extending to 110.2 hectares or thereby and being the subjects shown coloured pink and blue on the plan annexed and signed as relative hereto, which subjects form (first) part and portion of the subjects more particularly described in and disponed by disposition by arthur badenoch nicolson in favour of alexander harper recorded in the division of the general register of sasines applicable to the county of kincardine on 19 november 1952, and (second) the subjects more particularly described in and disponed by the disposition by patience mourilyan badenach nicolson in favour of robert michael forbes, recorded in the said division of the general register of sasines on 3 august 1967; together with (one) the fixtures and fittings therein and thereon, (two) the parts, privileges and pertinents thereof, and (three) the chargor's whole right, title and interest, present and future therein and thereto; and together also with in respect of the subjects (first) hereby secured (I) the rights set out in disposition by arthur badenoch nicolson in favour of alexander harper, recorded in the division of the general register of sasines applicable to the county of kincardine on 19 november 1952; (ii) the right to enforce the title conditions set out in disposition by robert michael forbes in favour of patience mourilyan badenach nicolson, recorded in the said division of the general register of sasines on 21 july 1967; (ill) the right to enforce the title conditions set out in deed of servitude by robert michael forbes in favour of jill macphie recorded in the said division of the general register of sasines on 31 march 1988; and (iv) the right to enforce the title conditions set out in disposition by robert michael forbes in favour of frederick powada and sandra powada, recorded in the said division of the general register of sasines on 3 june 1994.. for further information please see the charging instrument.
